European Commission should consider risks of AI systems within a rights-based framework - as risks they pose to human rights, rule of law and democracy.
The European Commission acknowledged in its White Paper on Artificial Intelligence that “The main risks related to the use of AI concern the application of rules designed to protect fundamental rights.” And yet, it intends to regulate AI from a risk-based approach that would focus on operational risks and those related to external factors.
Therefore, in our proposal we submitted to the European Commission we we suggested a new approach. The EU should:
- make the full use of the a thorough, inclusive and transparent human rights impact assessment (HRIA), and
- reject an over-simplified low-high risk structure and consider a tier-based approach on the levels of AI risk.
