Call for a Legal Expert to develop concept of the law on percentage designation in Moldova

The adopted Strategy for Development of the Civil Society in the Republic of Moldova for 2012-2015 envisions a supplementary measure for ensuring financial sustainability for Moldovan NGOs through directing part of the income tax in the amount of 2% to non-profit organizations with public benefit status. A working group composed of representatives of the Ministry of Finance, tax authorities and representatives of the Moldovan civil society has reviewed models for designation as applied in other countries and drew policy suggestions that need to be further put in place through developing a legal document on percentage designation.

In coordination with the local stakeholders, ECNL cordially invites applications from Moldovan legal experts to prepare concept of the law on percentage designation in Moldova.

ECNL works in Moldova within the framework of the Moldova Civil Society Strengthening Program (MCSSP) implemented by FHI 360. The Program is genereously supported by the United States Agency for International Development (USAID). More information on MCSSP is available here: http://fhi360.md/

Description of Tasks (tentative to be agreed on during contracting process):

  • Review existing European models, laws and policies for % designation;
  • Carry out legal assessment of the Moldovan framework on NGOs, framework on taxation and possible models for 2% designations by legal and physical persons;
  • Prepare scope of the needed legal changes;
  • In close cooperation with the Ministry of Finance, working group members and ECNL to develop concept of the percentage law with alternative models for % designation;
  • Participate in the working group meetings; Present suggested concept of the law to the working group members, state officials and NGOs.

Tentative timeframe:

April 8, 2013 – June 1, 2013. The first draft to be developed by May 1, 2013.

Qualifications and eligibility of the applicants:

  • Be a NIS national ;
  • Have a law degree from Moldovan or international University;
  • Have excellent analytical skills and experience in developing assessment, policy papers on NGO related issues;
  • Have understanding of the Moldovan NGO law and tax law;
  • Have working knowledge of English, i.e. be capable of reading and processing materials in English.
